## Prohibited signs in Indian Head Town

- No sign may be constructed, erected, moved, enlarged, illuminated or substantially altered except in accordance with the provisions of this ordinance, unless otherwise provided or exempted.
- No sign or supporting structure may be located in or over the traveled portion of any public right-of-way unless attached to a structural element of a building and an encroachment permit has been obtained.
- No sign shall obstruct a clear view to and from traffic along any street right-of-way entrance or exit.
- No sign may extend above any parapet or be placed upon any roof surface, except as specified.
- No sign attached to a building may project more than 12 inches from the building wall.
- No sign within 150 feet of a residential zone may be illuminated between midnight and 6:00 a.m. unless the impact is inconsequential.
- No sign may contain or be illuminated by flashing or intermittent lights or lights of changing degrees of intensity, except for signs indicating the time, date, or weather conditions.
- No illuminated tubings or strings of lights that outline property lines, sales areas, rooflines, doors, windows, or similar areas are permitted unless the lighting is integral to the sign or building design and approved by the Zoning Administrator.
- No off-premises signs may be located in any district except as may be provided in the Table of Permissible Uses, or exempted under §§ 440-1602 or 440-1603.
- No sign may be located so that it substantially interferes with the view necessary for motorists to proceed safely through intersections or to enter onto or exit from public streets or private roads.
- Signs that revolve or are animated or that utilize movement or apparent movement to attract attention are prohibited. Banners, streamers, animated display boards, pennants, and propellers are prohibited, but not occasional movement due to wind if not a primary design feature.
- No sign may be erected so that by its location, color, size, shape, nature, or message it would obstruct the view of or be confused with official traffic signs or other government signs.
- Freestanding signs must be securely fastened to the ground or some other substantial supportive structure so that there is virtually no danger of movement by the wind or other forces.
- No person may, for the purpose of enhancing visibility of a sign, damage, trim, destroy, or remove any trees, shrubs, or other vegetation in the public right-of-way, on others’ property, or areas protected by permit unless expressly authorized.
- No nonconforming signs may be enlarged or altered to increase nonconformity, nor may illumination be added.
- Nonconforming signs may not be moved or replaced except to bring them into full conformity.
- A nonconforming sign destroyed by natural causes may not be repaired, reconstructed, or replaced except in conformity with all provisions.
- No portable signs are permitted in any zoning district.

## Sign plan & submission notes

- In the case of a lot occupied or intended to be occupied by multiple business enterprises (e.g., a shopping center), sign permits shall be issued in the name of the lot owner or their agent, not the individual business enterprise. The Town may suggest a formula for dividing maximum square footage among tenants, but only the ordinance provisions are enforced by the Town, not the allocation formula.
- Sign permit applications and sign permits are governed by the same provisions applicable to zoning permits (cross-reference to general permitting process).
- All signs not specifically exempted require a sign permit issued by the Zoning Administrator.
- New signs in the Highway Corridor Overlay District are subject to Planning Commission review for design standards compliance.
