## Prohibited signs in Wilmington

- No sign shall contain statements, words or pictures which describe or display 'specified anatomical areas' or 'specified sexual activities', or contain vulgar language as defined by the ordinance.
- No sign shall be permitted on or protrude into a public right-of-way, street or passageway except as provided specifically in the ordinance.
- Except for signs installed by an appropriate governmental agency, no sign shall be attached to, hung or painted on any curb stone, hydrant, lamppost, barricade, temporary walk, telephone pole, telegraph pole, electric light pole or other utility pole, public fence or on a fixture of a fire alarm or police call system within any public right-of-way.
- No sign shall be permitted whereby its location, nature or type constitutes or tends to constitute a hazard to the safe and efficient operation of vehicles upon any public right-of-way, street or passageway.
- No sign shall be permitted that would obstruct the line of sight of motorists or pedestrians at intersections, driveways, or along any public right-of-way, street or passageway.
- No sign shall be permitted, as specified in G.S. § 136-32.2, that would obstruct or resemble traffic signs or signals or would tend to be confused with a flashing light of an emergency vehicle.
- No sign shall be permitted to prevent free ingress and egress from any door, window or fire escape.
- No sign shall be permitted containing or consisting of banners, posters, pennants, ribbons, balloons, streamers or other similarly moving devices or ornamentation, except as specifically provided in the ordinance.
- No sign shall be permitted which contains or utilizes revolving or rotating beams of light or stroboscopes.
- No detached sign shall be located closer than ten (10) feet in any direction from any power or transmission line.
- No detached sign shall be located within the triangular sight distance as defined in the ordinance.
- No sign shall be placed on a vehicle or trailer which is parked or located for the primary purpose of displaying said sign (except for permitted portable signs, or signs/lettering on buses, taxis, or vehicles operating during the normal course of business).
- No sign shall be erected which flashes. Animated signs are prohibited except for kinetic signs as specifically permitted.
- No new outdoor advertising signs (billboards) shall be permitted, except as provided for existing registered and relocated signs.
- All signs that are located within any public right-of-way in violation of this chapter may be removed and disposed of by the Code Enforcement Officer (or other public employee as authorized by the City Manager) without notice.
- Signs shall not be erected, constructed or maintained so as to obstruct any required exit, fire escape, window or door opening used as a means of egress.
- Signs shall not be attached in any form which will interfere with any opening required for ventilation, except for permitted exceptions.

## Signs exempt from permit in Wilmington

- The ordinance does not regulate official traffic signs, gravestones, lighting or displays of a seasonal religious or traditional nature (e.g., Christmas, Chanukah, Thanksgiving, Halloween lights or decorations) which are not commercially-oriented, scoreboards on athletic fields, or any display or construction not defined as a sign.
- The following types of signs are exempted from permit requirements, but must comply with all other requirements: signs used by churches, synagogues, or civic organizations; construction signs; directional/information signs of four (4) square feet or less; individual political signs; nameplates of four (4) square feet or less; public signs or notices or any sign relating to an emergency; real estate signs; incidental signs; residence signs or street address numbers not exceeding four (4) square feet; signs used for bona fide navigational aids; flags.
- Single-family detached residential lots of two (2) acres or less are exempt from the landscaping and tree preservation article (18-449(b)), and thus are not subject to landscape/sign planting requirements except as otherwise provided.
- All bona fide agricultural land use is exempt from the landscaping article (18-449(c)).
- City agencies are exempt from permitting fees under Sec. 18-6 for sign permits.
- Freedom of expression for noncommercial messages: It is permissible to place one sign not to exceed twelve (12) square feet in sign area containing a noncommercial message on any lot with owner permission. No permit is required, provided this sign is in compliance with other prohibitions/limitations.

- A sign plan must be approved by staff prior to installation of wayfinding signs in mixed-use (MX) districts; the sign plan must include all proposed sign dimensions, square footage, location, materials, and colors.
