## Prohibited signs in Jacinto City

- It shall be unlawful for any person, firm, or corporation to erect any outdoor sign or billboard that is visible from a public way except in conformance with this Section.
- It shall be unlawful to construct an outdoor sign or billboard within the municipality without first having secured a permit therefor.
- No license issued under the provisions of this Subsection shall be construed to authorize the construction or maintenance of an outdoor sign or billboard which extends over, or any part of which extends over, on or above, any public street, alley, sidewalk, or public place or on any place in violation of any ordinance of the City.
- No outdoor sign or billboard shall be attached to any tree, fence, or utility pole or be painted upon or otherwise directly affixed to any rock, ledge, or other natural feature.
- No outdoor sign or billboard shall be erected at any location where, by reason of position, shape, wording, or color, it interferes with or obstructs the view of pedestrian or vehicular traffic.
- No outdoor sign or billboard shall be erected which may be confused with any authorized traffic sign, signal, or device.
- No outdoor sign or billboard shall be erected within an area designated by the zoning ordinance as a single family residential area.
- All signs and their supporting structures shall be properly maintained to prevent rust, rot, peeling, or similar deterioration.
- Any outdoor sign or billboard which advertises, identifies, or pertains to an activity no longer in existence shall be removed by its owner or person otherwise responsible within thirty (30) days from the time the activity ceases existence.
- No outdoor sign or billboard shall have visible moving parts.
- No outdoor sign or billboard shall have blinding, moving, or glaring illumination.
- No outdoor sign or billboard shall consist of banners, pennants, ribbons, streamers, or similar devices; provided, however, that such devices may be permitted to advertise grand openings of new or different businesses so long as such devices are removed fifteen (15) business days after they are installed.
- No sign shall be closer than five (5') feet to a lot line; or thirty-eight (38') feet to the center line of any public way which has a right-of-way of less than sixty-six (66') feet in width; or sixty-five (65') feet to the center line of any public way which has a right-of-way less than one hundred twenty (120') feet in width.
- No outdoor sign or billboard of any type may be placed within any right-of-way or easement as determined by a legal authority.
- No individual sign shall contain more than one hundred fifty (150) square feet of sign area.
- No individual sign shall have a height greater than thirty (30) feet above the ground level of land upon which it is located, or, if the sign is a roof sign, be more than ten (10) feet above the roof of a building.
- No ground sign which contains more than one hundred (100) square feet of sign area may be closer than thirty (30) feet to any other ground sign on the same premises which contains more than fifty (50) square feet of sign area.
- Wall signs must occupy no more than forty (40) percent of the wall to which they are attached or affixed and, in any case, must not contain more than one hundred (100) square feet of sign area.
- Roof signs may only be displayed in place of wall signs and are subject to the same space limitation.
- Projecting signs may not extend above the second floor and their maximum sign area is fifty (50) square feet.
- No outdoor sign or billboard shall be erected within thirty (30) feet of any single family or multiple family dwelling.
- All signs must be constructed in a safe and good workmanlike manner and must not be offensive to the surrounding areas as determined by the city manager.

- No garage sale signs shall be permitted on any utility poles nor shall any such signs be posted in any manner which might constitute a traffic hazard or posted in such a manner as to become litter.
- All garage sale signs must be anchored or affixed so as not to be blown away or become unsightly litter within the city.
- Failure to remove garage sale signs within twenty-four (24) hours after the final day of such garage sale is unlawful and constitutes littering.
- Commercial businesses shall not be permitted to post garage sale signs within the city.
- No person shall post garage sale signs advertising a continuous garage sale.

## Signs exempt from permit in Jacinto City

- Political signs advertising or campaigning for political candidates or referendums during specific election periods shall be exempt from this section, provided, however, no such political sign shall be permitted to remain more than ten (10) days after such election or runoff election as the case may be and shall be removed by the person(s) who erected the same.

## Sign plan & submission notes

- Applications for sign permits are required and must be made in writing to the City Secretary; the application must include the name of the owner of the premises, the name of the person or corporation constructing the sign or billboard, and specifications showing the size, materials, and manner of construction of the sign or billboard.

- If the building official and city manager reject the application for a permit to erect such signs along the IH-10 service road, the applicant may appeal to city council, which will make the final determination after a hearing.
- No sign may be erected along the IH-10 service road without prior approval of the building official and/or the city manager, including submitted plans and specifications when the sign exceeds twenty (20) feet in height and/or is in excess of one hundred fifty (150) square feet in area.
- Mobile, trailer, portable, or temporary signs may only be placed after obtaining a special use permit from the City Secretary; such permits may only be issued for periods not to exceed thirty (30) days and not more than once every three (3) months for any person or business.
- Garage sale signs may only be posted for sales with a valid garage sale permit (application required), and the number of signs is limited to 10, each with the permit affixed; non-residents and residents are limited to four postings per year, and other restrictions apply.
