  • Automated signs are prohibited within the Downtown Development Area (DDA), Transitional Development Area (TDA), Community Entry Development Area (CEDA), and in Residential and Public/Semipublic zoning districts (8-2A-8(C)(8)(b)).
  • Automated signs may not operate with full animation, growing, flashing, rotating content, or other illusions of movement, except for single color text-only message displays scrolling or traveling across the sign area (8-2A-8(C)(8)(c)).
  • Automated signs may not change frame content more often than once every 8 seconds, and the change must occur in less than one second (8-2A-8(C)(8)(d)).
  • The automated portion of any sign may not exceed 20% of the face of any sign (8-2A-8(C)(8)(f)).
  • Where more than one sign is allowed on a site, only one may contain an automated sign (8-2A-8(C)(8)(g)).
  • Adding an automated sign to any nonconforming sign is prohibited (8-2A-8(C)(8)(h)).
  • Any conforming existing sign or portion of a conforming existing sign that is refaced with an automated sign requires design review approval (i.e., is prohibited without such approval) (8-2A-8(C)(8)(i)).

Exempt Signs in Eagle

  • The provisions and requirements of the sign article do not apply to exempt signs listed in 8-2A-8(C)(16), except that no exempt sign may block ADA accessible sidewalk requirements or the sight vision area of an intersection as determined by ACHD.
  • Public convenience signs not exceeding 6 square feet in area, erected for the convenience of the public (e.g., restrooms, public telephones, walkways and similar features), are exempt (8-2A-8(C)(16)(a)).
  • On-premises directional signs not exceeding 6 square feet in area are exempt (8-2A-8(C)(16)(b)).
  • Memorial signs or tablets, names of buildings, and dates of erection of a building or structure are exempt (8-2A-8(C)(16)(c)).
  • Traffic or other municipal signs, including traffic signals, railroad crossing signs, legal notices, and temporary emergency or nonadvertising signs authorized by the city council, are exempt (8-2A-8(C)(16)(d)).
  • Emergency service signs for police, emergency rooms, fire departments, hospitals, and similar emergency services are exempt (8-2A-8(C)(16)(e)).
  • Public utility company signs indicating danger or showing the location of utility facilities are exempt (8-2A-8(C)(16)(f)).
  • Address numbers and letters for address identification are exempt (8-2A-8(C)(16)(g)).
  • Nonilluminated or externally illuminated warning signs (e.g., “No Trespassing”, “No Parking”, “No Dumping”) not exceeding 6 square feet and located on the lot to which they are appurtenant are exempt (8-2A-8(C)(16)(h)).
  • Reasonable seasonal decorations within the appropriate holiday season are exempt, provided they are removed at the end of the public holiday season (8-2A-8(C)(16)(i)).
  • Government or noncommercial institutional flags are exempt (8-2A-8(C)(16)(j)).
  • One commercial flag per business, not exceeding 20 square feet in surface area, left loose to fly in the breeze, and with a maximum height of 15 feet, is exempt (8-2A-8(C)(16)(k)).
  • Art such as sculptures, fountains, mosaics and design features that do not incorporate advertising or identification is exempt (8-2A-8(C)(16)(l)).
  • Murals that are not used to advertise the business, are artistic and nostalgic in nature, follow the Eagle architecture theme, and have been recommended by the Eagle arts commission and approved by the design review board and city council, are treated as art and exempt (8-2A-8(C)(16)(m)).
  • Historic signage for any business within the design review overlay district which the design review board finds to be of local historical significance is exempt from the provisions of the article (8-2A-8(C)(16)(n)).
  • Nonilluminated window signs are exempt so long as the total window area covered does not exceed 25% of the total window area of all windows facing public streets (8-2A-8(C)(16)(o)).
  • Neon window signs no larger than 4 square feet or 10% of the window where placed (whichever is larger), and no more than two neon window signs per street frontage, are exempt (8-2A-8(C)(16)(p)).
  • Door signs identifying the business and/or indicating business hours, emergency phone numbers, etc., up to a maximum of 2 square feet, are exempt (8-2A-8(C)(16)(q)).
  • Latex and mylar style party balloons 24 inches or less in diameter are exempt (8-2A-8(C)(16)(r)).
  • Displays of items for sale located at any City‑approved business site, provided they are not within any landscape area or required parking area (except as part of a community event), are exempt (8-2A-8(C)(16)(s)).
  • Signs located inside buildings or within enclosed lobbies or courts of buildings, designed and located to be viewed exclusively by patrons of such use, are exempt (8-2A-8(C)(16)(t)).

Sign Plan & Submission Notes for Eagle

  • A Master Sign Plan is defined as a plan showing the relationship of signs for any cluster of buildings intended for business occupancy, any single building containing more than one business, or any arrangement of business buildings or shops constituting a visual entity, including shopping centers, mini-malls, business parks, and multi-tenant buildings with four or more businesses. A master sign plan may also be submitted voluntarily for a single business (definition of MASTER SIGN PLAN).
  • A Master Sign Plan is required to be submitted to the City for review and approval (8-2A-8(C)(15)). The City uses it to coordinate signs and establish an overall sign design for a building or site, including sign colors, styles, building locations, maximum size, illumination, and materials.
  • Under a Master Sign Plan, the City (via the design review board) may suspend or relax sign height, area, number, or location standards if extraordinary conditions exist and the variation still meets the intent of the article, including situations with unique site topography, size, proportion, or relation to streets; unique land use, architecture, scale, or historical interest; or signage incorporating special design features such as logos, emblems, murals, or statuaries that are architecturally compatible (8-2A-8(C)(15)(a)–(c)).
  • Any conforming existing sign, or portion thereof, that is refaced with an automated sign requires design review approval (8-2A-8(C)(8)(i)).
  • A Master Sign Plan may be developed by the City as a City entry statement and cooperative sign plan to specify design criteria, aesthetics, locations, and funding methods for future cooperative business identification and directional signage, including City entry signs and streetlight signage (8-2A-8(D)).
  • Signs on City-owned or controlled property require prior written permission from the City and a sign approval application with any additional information required by the zoning administrator. Unless otherwise specified, such permits expire 12 months from issuance (8-2A-8(C)(17)(a)).
