Prohibited Signs in Lincoln

  • No sign shall be located in a required yard or encroach upon or overhang any adjacent property or public right-of-way, unless expressly allowed elsewhere in the code.
  • No sign shall be erected upon or against a roof or on top of or above the parapet of a building, except roof signs as permitted in Section 27.69.310.
  • No sign shall exceed the maximum building height permitted in the zoning district where the sign is located.
  • Every sign must be permanently attached to the ground or to a building or structure permanently attached to the ground; portable or non-attached signs are prohibited except for mobile and temporary signs as expressly allowed.
  • No sign shall be painted on or attached to rocks, trees, or any other natural object.
  • No sign shall be erected, placed, or maintained where it violates sight-obstruction regulations at street intersections or entrances/exits from private property.
  • No sign or part thereof shall be erected in areas adjacent to or within interstate and federal-aid primary road systems in contravention of State of Nebraska advertising controls.
  • No sign shall be located closer than 50 feet to an abutting residential premises in a residential district if non-illuminated, or closer than 100 feet if illuminated.
  • No sign shall move, rotate, revolve, or simulate animation by means of spinning, fluttering, or reflective devices or lighting; limited rotation/revolving is allowed up to six revolutions per minute.

Exempt Signs in Lincoln

  • Non-illuminated temporary signs are allowed in all zoning districts, subject to size limits: up to 10 sq ft in residential districts and up to 40 sq ft and 6 ft height in nonresidential districts, including temporary real estate signs, temporary construction signs (one per contractor), and temporary noncommercial signs.

  • In any zoning district, one non-illuminated, non-reflecting wall sign not exceeding 2 sq ft in area is allowed.
  • Seasonal or holiday signs or decorations for religious or national holidays are allowed in all zoning districts; they may blink, flash, or move and may be located in a required yard, provided they do not interfere with traffic or otherwise present a public hazard.
  • Murals (exclusive of any sign area) are allowed in all zoning districts with a permit from the Department of Building and Safety, provided they do not interfere with traffic or present a public hazard.
  • Historically significant signs may be exempted from the chapter’s provisions by City Council resolution or by conforming to applicable historic preservation ordinances.
  • Subdivision promotion signs for the original sale of lots are allowed in any zoning district; they must be nonilluminated and comply with area limits (one sign ≤100 sq ft on tracts ≤10 acres; up to two signs with composite ≤150 sq ft and no single sign >100 sq ft on tracts >10 acres).
  • Directional signs are permitted in all districts subject to area limits (≤2 sq ft in a front yard; ≤6 sq ft outside the front yard).
  • Any permitted on-premises or off-premises sign may display noncommercial messages (e.g., political, religious, charitable, sociological, or ideological) notwithstanding other provisions.
  • Banner signs may extend up to 6 inches into the public right-of-way if located 8 feet or more above grade; banners may extend over public property and across a public street only with the Mayor’s permission and must maintain at least 20 feet of clearance.

If a special permit has been issued for the cemetery, the plan may be approved by administrative amendment under Section 27.63.030; City Council may modify plan regulations when granting a special permit.
  • Special Sign District Formation (nonresidential): Occupants of at least 60% of the street frontage of a block face may petition City Council to create a special sign district with proposed sign criteria that may be more or less restrictive than the underlying district. In nonresidential landmark districts, the Planning Director may petition for a special sign district. Process involves Historic Preservation Commission hearing and recommendation (for landmark districts), Planning Commission public hearing and report, and final City Council action. The Planning Director may approve minor amendments to an adopted special sign district under certain conditions.
  • General modification authority: City Council may modify sign regulations for location, height, and area in connection with granting a special sign district, a planned unit development, a use permit, a special permit for a community unit plan, or a special permit for a planned service commercial development (Section 27.69.030(a)(12)).
