Prohibited Signs in Norfolk

  • No sign may be located within any required yard area other than the front yard; no sign may be closer to the front lot line than allowed; and no sign may be located within the area of the required side yard extended to the front street line.
  • No sign may encroach into the public right-of-way of any street or highway (except as expressly allowed for certain public or destination/promotional signs).
  • All signs must be maintained in good repair and in a safe, neat, clean, and attractive condition; neglected or unsafe sign conditions are prohibited.
  • Obsolete signs must be removed within six months (one six-month extension may be granted); failure to remove allows the city to remove the sign and assess costs to the property.
  • Prohibited lighting includes flashing signs or lights (except message signs no larger than 24 square feet where permitted), stroboscopic lights, rotary beacons, unshielded flood lights, exposed incandescent bulbs over 30 watts, and any lighting that could be confused with traffic control devices or that creates a traffic hazard.
  • No signs or lettering may be placed on or affixed to moving vehicles or parked vehicles/trailers for the apparent purpose of advertising or directing people to a business or activity when visible from a public right-of-way.
  • Except as otherwise provided, no sign or promotional device may be erected or hung over any sidewalk, street, avenue, or alley.
  • It is unlawful to situate, place, operate, or use any sign upon a street, alley, public right-of-way, across any sidewalk line, or within the front yard setback of any zoning district unless permitted by district height and yard regulations.
  • Temporary signs are prohibited in the public right-of-way and are subject to immediate removal if placed there.
  • No temporary signs are allowed within the sight triangle.
  • Unauthorized posting, pasting, or painting of any signs or advertising on any sidewalk, curb, pavement, or on any fence, pole, post, or building without the owner’s permission is unlawful.

Exempt Signs in Norfolk

  • Public signs defined in Sec. 27-2 may encroach into the public right-of-way; if not of MUTCD-approved design, they may be permitted only after an agreement approved by the city council specifying locations, size, and design.
  • Destination signs are allowed in all zoning districts and may be placed in the public right-of-way on arterial streets with zoning official approval, provided placement meets MUTCD criteria; applicants are responsible for the cost of installation, maintenance, and replacement.
  • Signs permanently affixed to or integral to a motor vehicle and bumper stickers are exempt from the prohibition on vehicle-based advertising; signage incidental to the primary use of the vehicle/trailer is also allowed.
  • Civic, philanthropic, educational, or religious organizations may receive a special permit to hang temporary promotional devices over public ways; these promotional devices are exempt from permit fees.
  • Promotional devices may display advertising as a temporary building sign or freestanding temporary sign for up to 120 hours without a permit if the Planning and Development Department is notified prior to display.
  • Existing permanent signs at the effective date are grandfathered as legal nonconforming (except certain signs projecting into the right-of-way); copy may be changed or replaced without enlarging sign area; existing sign bases/supports without a sign may host a sign meeting current area limits upon application to the Planning and Development Department; signs relocated due to public projects may be re-set at the same setback provided no part extends into the right-of-way; pre-existing projecting signs may remain until structurally altered or destroyed.
  • One non-illuminated construction project sign (up to 80 square feet) listing architects, engineers, builders, contractors, or future tenants is allowed on the premises during construction and must be removed upon completion of the building.
  • Itinerant merchants, peddlers, solicitors, street vendors, or temporary merchants holding a valid city permit may have one temporary sign during the permit period.
  • Election signs supporting or opposing a candidate or proposition are exempt from the one-temporary-sign-per-premises limit and must be removed within five days after the election.
  • The following sign types are not subject to the temporary sign section: official public notices; underground utility identification signs; danger or warning signs; no trespassing signs; private property signs; zoning revision notice signs; OSHA-required signs; signs required on federally funded projects; and promotional devices allowed under Sec. 27-321(j).
  • Temporary signs up to 32 square feet for civic, philanthropic, educational, or religious organizations are allowed in all zoning districts for up to one month.

Sign Plan & Submission Notes for Norfolk

  • Freestanding signs with sign area over 300 square feet require a conditional use permit to be located (applicable in C-3, I-1, I-2, I-3), with minimum 40-foot setback and maximum 50-foot height.
  • A special permit by the mayor and city council is required to hang temporary promotional devices over sidewalks, streets, avenues, or alleys.
  • Placement of public signs in the right-of-way that are not of MUTCD-approved design requires an agreement with the city approved by the city council specifying location, size, and design.
  • Destination signs placed in the public right-of-way require approval by the zoning official or designee and must meet MUTCD criteria; applicants are responsible for installation, maintenance, and replacement costs.
  • To use the 120-hour no-permit allowance for promotional devices, prior notification to the Planning and Development Department is required; failure to notify makes the display subject to regulation as a temporary sign and requires a temporary sign permit.
  • Emergency directional signs at hospitals require location approval by the Planning and Development Department.
